Terms of Service

These terms are a contract between Forty Four Design Limited, a company registered in England and Wales (company number 13704554, registered office 39 South Street, Chichester, PO19 1EL) ("we", "us"), and the organisation or individual that registers a LatestDrawing.com account ("you", "your studio").

By creating an account or using the service you agree to these terms. If you are registering on behalf of an organisation, you confirm you have authority to bind it.

1. The service

LatestDrawing.com provides a hosted register for construction drawings and project documents: revision tracking, QR-stamped drawings, site changes, and sharing with project participants. We provide the platform; we do not review, verify or approve the content of any drawing or document.

Important: LatestDrawing.com is a document-management tool, not a substitute for professional judgment or contractual document-control procedures. You and your project participants remain solely responsible for verifying that any drawing used for construction is the correct and current revision.

2. Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your studio's accounts. Notify us promptly at hello@fortyfourdesign.co.uk if you suspect unauthorised access. You must be at least 18 to hold an account.

3. Your content

You own it. Drawings, documents and other content you upload remain yours (or your licensors'). We claim no ownership.

You licence us to host it. You grant us a worldwide, non-exclusive licence to store, copy, process, display and transmit your content solely as needed to provide the service — for example, generating previews, stamping QR codes, and delivering files to the project participants you authorise. This licence ends when the content is deleted, subject to a short period for removal from backups.

You are responsible for it. You confirm you have the rights needed to upload your content and to share it with the participants you invite, and that your content does not infringe anyone's rights or break the law.

Project participants. When you invite others to a project, you are responsible for having the right to share the relevant documents with them and for the accuracy of the contact details you provide. For personal data you add about others, you are the data controller and we process it under the Data Processing Agreement, which forms part of these terms.

4. Acceptable use

You must not: use the service unlawfully; upload malware or content that is infringing, defamatory or unlawful; attempt to access other studios' data; probe, disrupt or overload the service; resell the service; or use automated means to scrape it. We may suspend accounts that put the service or other customers at risk, and will tell you why unless the law prevents us.

All plans include unlimited revisions. To keep the service fast and reliable for everyone, storage is subject to the following fair use limits. The vast majority of practices will never come close to these thresholds:

5. Plans, billing and changes

Free plan. The free plan is provided as-is, with the limits published on our pricing page, and may be changed on reasonable notice.

Paid plans. Paid plans are billed monthly in advance via Stripe at the prices shown at purchase. Prices include VAT. You can upgrade at any time; the change takes effect immediately with a prorated charge. To downgrade, contact us — downgrades take effect once your member and project counts fit within the lower plan's limits.

Non-payment. If a payment fails we will retry and notify you. If payment remains outstanding 14 days after the due date we may suspend paid features; your data remains intact during suspension. If payment remains outstanding 60 days after the due date we may close the account under clause 8.

Price changes. We will give at least 30 days' notice of price increases, which take effect at your next billing cycle after the notice period. If you do not accept an increase you may cancel before it takes effect.

Cancellation. You may cancel at any time from Studio Settings. Cancellation takes effect at the end of the current billing period. Fees already paid are non-refundable except where the law requires otherwise.

6. Availability and support

We aim for high availability but do not guarantee uninterrupted service, and no service level agreement applies unless separately agreed in writing. We may perform maintenance, with advance notice where practicable. Support is provided by email at hello@fortyfourdesign.co.uk during UK business hours.

7. Data protection and security

We process personal data as described in our Privacy Policy and, where we act as your processor, under the Data Processing Agreement. We implement appropriate technical and organisational measures including encryption in transit and at rest and access controls. You are responsible for the accuracy of data you upload and for maintaining your own copies of business-critical documents (see clause 9).

8. Termination

You may close your account at any time. We may terminate: (a) for material breach not cured within 14 days of notice; (b) immediately for serious breach of clause 4 or unlawful use; (c) for non-payment under clause 5; or (d) on 90 days' notice if we discontinue the service.

On cancellation of your account, we will make your content available for export for 30 days (unless terminated for serious breach), after which it is deleted in line with our Privacy Policy. After your account is deleted, all of the data associated with your account is deleted from our database and unrecoverable. Clauses that by their nature should survive (including 3, 9, 10 and 12) survive termination.

9. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to that:

• We are not liable for construction decisions. You acknowledge that the service is a document register and that responsibility for using the correct revision of any drawing rests with the people carrying out and supervising the work. We are not liable for losses arising from reliance on any document, revision status or notification in the service.
• No indirect losses. Neither party is liable for indirect or consequential loss, loss of profit, loss of business, or loss of data (except as covered by our obligations in clause 7).
• Cap. Our total liability arising in any 12-month period is limited to the fees you paid us in that period, or £100 if you are on the free plan.
• Your responsibility for backups. The service is not an archival or disaster-recovery system of record. Maintain your own copies of all documents especially those which you are contractually required to retain. We are not responsible for loss, damage or corruption of documents uploaded to latestdrawing.com.

10. Intellectual property in the service

We (and our licensors) own the service, its software, design and branding. These terms grant you a right to use the service, not any rights in it. Feedback you give us may be used without obligation.

11. Changes to these terms

We may update these terms. For material changes we will give at least 30 days' notice by email or in-app notice. Continued use after the effective date constitutes acceptance; if you do not accept, you may cancel under clause 5.

12. General

These terms, the Privacy Policy and the Data Processing Agreement are the entire agreement between us regarding the service. If any provision is unenforceable, the rest remains in effect. Neither party is liable for failure caused by events beyond its reasonable control. You may not assign these terms without our consent; we may assign them as part of a reorganisation or sale of our business. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
